Terms of purchase

1. GENERAL

1.1

These general terms and conditions (the “Terms”) apply when you, as
consumer (“You” or “Customer”) places an order via Artiley AB’s website (“Website” or “Site”). An agreement is concluded between you and ARTILEY AB. Detailed contact details and other information about Artiley are provided on the Website. The terms and conditions are only applicable to you who are a consumer and who place orders via the Website.

1.2

In order to order on the Website, you must, in accordance with Swedish law, be 18 years of age or older. When you place an order on the Website, you as a Customer confirm that you are at least 18 years of age and are legally entitled to place an order on the Website. Artiley reserves the right to refuse or change your order in individual cases (for example, if you have provided incorrect personal information and/or have payment complaints).

1.3

The website and all content on it are owned by Artiley, its licensors or other third parties. The information is protected by, among other things, intellectual property and market laws. This means that trademarks, company names, product names, images and graphics, design, layout and information about goods, services and other content may not be copied or used without written permission from Artiley.

2. AGREEMENT AND ORDER

2.1

In order to place an order on the Website, you must accept the Terms and Conditions. By accepting the Terms and Conditions, you agree to comply with the Terms and Conditions in their entirety, and acknowledge that you have read the information about personal data and consented to the use of personal data and cookies in accordance with Artiley's privacy policy.

2.2

A purchase agreement is only concluded when Artiley has confirmed your order and you have received an order confirmation from Artiley by email. Artiley encourages you to save this order confirmation for any contact with Artiley's customer service. You can cancel your order until it has been confirmed by Artiley. If the order is canceled, Artiley will refund any payments that you or your payment or credit card companies have made in relation to the order.

3.1

4. PRICES, FEES AND PAYMENT

4.1

The prices stated on the Website are those applicable when You place an order on the Website. The prices stated on the Website include the standard shipping fee.

VAT is included in the price when you purchase from Norway, Sweden and other EU countries but is not included when you purchase from other countries that are not part of the EU. You are responsible for paying any additional costs, taxes or customs duties that may apply in your jurisdiction when you place an order on our Website.

4.2

You can pay in the ways stated on the Website. Read more about Artiley's different payment methods on the Website. Artiley has the right to charge you already in connection with the order, unless invoice payment or a similar payment method has been chosen by you and approved by Artiley. In such a case, you will be informed of this. Artiley reserves the right not to always offer all payment methods, or to change the payment method if the one you have chosen for some reason does not work.

4.3

5. DELIVERY AND TRANSPORTATION

5.1

From the time Artiley has confirmed the Customer's order by e-mail through order confirmation, goods are delivered within the number of working days stated on the Website.

5.2

Unless otherwise agreed,
You have the right to cancel the purchase if the delivery is delayed by more than 30 days and it is not
is caused by you as the Customer.

5.3

If a package is to be picked up at a delivery location, you must do so within the time frame specified in the notification. Packages must normally be picked up in person with valid identification and a reference number. The customer
will be notified where and when the package is to be picked up. Artiley is under no circumstances liable for any direct or indirect additional costs or expenses incurred by the Customer, for example as a consequence of the Customer not picking up the package on time. Artiley has the right to charge the Customer a fee if the package is not picked up on time.

6. RIGHT OF WITHDRAWAL

6.1

We offer no cancellation rights for orders. Each painting is printed and stretched on canvas in the size you choose to order, making each order unique and customized for you.

7. COMPLAINT

7.1

If a product is damaged, missing or subject to a fault that is not the result of your own actions, you are entitled to have a new product sent to you at no extra cost. All Customers who wish to exercise their right to file a complaint for an ordered product should contact Artiley as soon as possible after the fault was discovered. You must provide your name, address and why you wish to make a complaint. You must also provide other relevant information such as the order number, the name of the product and the quantity you wish to return. E-mails about returns should be sent to our customer service at
info@artiley.se.

7.2

Artiley normally investigates the right to a refund or compensation within 14 working days of receipt of such a claim. Artiley reserves the right to refuse a complaint if it turns out that the product is not defective according to applicable consumer protection legislation. When making complaints, Artiley follows guidelines from the Swedish General Complaints Board.

8. OTHER WEBSITES

8.1

The website may contain links to websites owned by third parties. Artiley is not responsible for the management, security, content or
any other aspect of these.

9. FORCE MAJEURE

9.1

Artiley reserves the right to invoke Force Majeure in such situations where this is applicable. Artiley is not responsible for delays caused by such circumstances as they are beyond Artiley's control. If the situation has lasted for more than two months, both the customer and Artiley have the right to terminate the purchase with immediate effect.

10. CHANGES TO THE TERMS

10.1

Artiley reserves the right to change these terms and conditions.
Any changes to the terms and conditions will be posted on the website.
Changes will apply once you have accepted the terms (in connection with a
new purchase or while browsing the Website), alternatively 30 days after
Artiley has informed you as a Customer about the changes.

11. APPLICABLE LAW AND DISPUTES

11.1

If a dispute arises between you and us (Artiley), we strongly encourage you to first contact us directly to seek resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration.

In the event of a dispute, we (Artiley) will follow decisions from ARN (the Swedish General Complaints Board) or equivalent dispute resolution body.
